The present agreement governs the relationship between Everlight Studios LLC (hereinafter “PC”, “us” or “we”) and the user (hereinafter “you”, “they”, “user”). The scope of the present terms shall apply to this website, mobile application developed by Everlight Studios LLC for its services, services of the its affiliate entities including joint ventures, subsidiaries, parent and sister companies and any other related corporate entity.

“Creator” means an individual who creates and publishes content on pinkcuffs.com to be viewed by other users

INTERPRETATION

The language of the terms shall be English and shall be the official language for any construction or interpretation.

The present agreement is reflection of entire understanding of our relationship with you. It shall supersede any previous or other such understanding.

In case there exists a machine readable form of these terms, and arises a conflict between human readable form and machine readable form, the human readable form shall prevail.

ACCEPTANCE

By creating your account and accessing the services provided by us, you expressly agree to be bound by our access rules, privacy policy and terms of service.

By accepting these Terms & Conditions and / or registering with us, you are validating that you must be of the minimum age of eighteen (18) and persons under the age of 18 may not use the Services and should not register. MEMBERSHIP

Pink-Cuffs’ services and products are offered exclusively to private users. We reserve the right to exclude anyone and everyone from participation in contests or chat and reserve the right to close any user account at any time for any reason without any prior notice.

We, at Everlight Studios LLC, offer paid membership account to allow our users to enjoy the photos and videos of our models. The users must have a single account at a time after paying the membership due.

Our membership is limited to countries where nudity, making and selling of explicit content is permitted. If you are accepting our membership from a region where it is not allowed, you certify to hold us harmless against any proceedings.

REGISTRATION
During the registration process, you will need to first register for an account by choosing a unique USER ID. The USER ID must not be offensive, be deceptive or misleading, may not offend common decency or infringe the intellectual property rights of third parties. PC reserves the absolute right to replace or amend any username without prior notice.

During the registration process, the user also chooses a password. The user account may be used only by the user and not by anyone else. The password is only asked when logging in. You are responsible for keeping your user account password confidential and will not ever be provided to anyone else. The moment it is generated by machine, it is transferred to you without any delay. The user id and password are non-transferable. You agree that your user account may only be used by you and not by anyone else. All details which you provide to PC either during the registration process or at any time thereafter must be true. We reserve the right to run checks with third party agencies using the information you provide us on registration. For other information such as shipping address, email address, and telephone number are required at the time of registration and the information you provide us must be true.

Once all the information is provided, your account is created.

ACCOUNT CANCELLATION

We reserves the right to cancel your account for any reason whatsoever at any time without notice to you. Your account may be cancelled if-

1. You have more than one active account for the Website.
2. The name on your account doesn’t match the name on the credit card(s) used to make purchases on your account.
3. You have provided incorrect information in relation with bank, personal and related data.
4. You are not eighteen (18) EIGHTEEN years of age or older.
5. You have permitted someone else to use your account intentionally or unintentionally.
6. You are found to be cheating or attempting to defraud the Website, or if you make untrue and/ or malicious comments with regard to the operations of PC, PC reserves the right to publicize your actions together with your identity and e-mail address, as well as to circulate this information to banks, credit card companies, and appropriate agencies.

INDEMNIFICATION

Content Creator Agreement

As a Creator on pinkcuffs.com, you agree to the following terms when you verify your account

PC prohibits any activity that is illegal or otherwise violates our terms

PC requires the creator to obtain and keep on record written consent from all individuals depicted in any form of content posted on pinkcuffs.com swearing consent to:

• Public sharing of the content and to upload the content to pinkcuffs.com
• Content will be viewable to all subscribers on pinkcuffs.com
• Documentation to prove an age of atleast 18 years old with documented evidence such as a valid photo ID
• Allows PC to view and access verification documents

Contract Termination

On Pinkcuffs.com, the contract period will continue as long as the creator does not close the account

Confidentiality

This agreement is strictly confidential and only authorized personnel are allowed to access.

Signature

Anyone who registers as a Creator and confirms their account is considered to have accepted this agreement. If you do not accept the agreement, please close your creator account.

APPLICABLE LAW and JURISDICTION

This Terms & Conditions Agreement has been drafted in accordance with the laws, regulations, and guidelines of the State of Arizona, and your use of PC shall be governed by the courts of the State of Arizona. The courts of the State of Arizona are the first and exclusive court of jurisdiction for any litigation should it arise.

SEVERABILITY

Every clause of these terms of service is lawful unless adjudicated otherwise by a competent court as defined in the terms of use. PC maintains that if any of the clauses or section of these terms of service is adjudicated as unenforceable by a competent court, it shall not affect the enforceability of the rest of the policy. The rest of the content of this agreement shall continue to be in force without any change in understanding.
